Guide to Online Gambling in Arizona

In April 2021, Arizona's Governor, Doug Ducey, gave the nod to a bill that ushered in the era of legal sports betting in the state. This approval was a sequel to the U.S. Department of Interior sanctioning amendments to Arizona's gaming agreement with tribal entities.

 

Consequently, both brick-and-mortar and online sports betting have become legal avenues in Arizona, with provisions to issue up to 20 licenses – split evenly between tribes and professional sports entities. However, these casinos are not yet able to provide online poker, tables, or slots. Regarding online gambling, Arizona has yet to establish a regulated framework or any guidance prohibiting the act of online gambling outside of the state regulated casinos.

There's an absence of clear-cut legislation for online poker and sports betting, the ambiguous nature of the law doesn't equate to criminality. To date, no Arizonian has faced legal consequences for online poker play. With this, the regulatory landscape suggests that Arizonians, aged 18 and above, have the liberty to bet and earn real cash on gambling websites licensed and overseen outside the USA.  Nevertheless, it's prudent for residents to tread cautiously in the realm of online gambling and seek legal counsel if uncertainty arises.

Arizona Online Gambling Overview

  • As of April 2021, online sports betting became legal in Arkansas

  • Though there are laws limiting in-person betting, there are no laws prohibiting or restricting online betting

  • Twenty operators currently carry state licenses, but no offshore gambling sites have been prohibited

Applicable Arizona Online Gambling Laws

Definitions

8. “Regulated gambling” means either:

(a) Gambling conducted in accordance with a tribal-state gaming compact or otherwise in accordance with the requirements of the Indian gaming regulatory act of 1988 (P.L. 100-497;  102 Stat. 2467;  25 United States Code sections 2701 through 2721 and 18 United States Code sections 1166 through 1168);  or

(b) Gambling to which all of the following apply:

(i) It is operated and controlled in accordance with a statute, rule or order of this state or of the United States.

(ii) All federal, state or local taxes, fees and charges in lieu of taxes have been paid by the authorized person or entity on any activity arising out of or in connection with the gambling.

(iii) If conducted by an organization which is exempt from taxation of income under section 501 of the internal revenue code,  2 the organization's records are open to public inspection.

(iv) None of the players is under twenty-one years of age.

(c) Event wagering that is conducted pursuant to title 5, chapter 11.

Arizona Revised Statutes Title 13. Criminal Code § 13-3302. Exclusions

A. The following conduct is not unlawful under this chapter:

1. Amusement gambling.

2. Social gambling.

3. Regulated gambling if the gambling is conducted in accordance with the statutes, rules or orders governing the gambling.

(b) Winnings subject to withholding—(1) In general. Winnings subject to withholding means any payment from—

(i) A wager placed in a State-conducted lottery (defined in paragraph (c)(2) of this section) but only if the proceeds from the wager exceed $5,000;

(ii) A wager placed in a sweepstakes, wagering pool, or lottery other than a State-conducted lottery but only if the proceeds from the wager exceed $5,000; or

(iii) Any other wagering transaction (as defined in paragraph (c)(3) of this section) but only if the proceeds from the wager:

(A) Exceed $5,000; and

(B) Are at least 300 times as large as the amount of the wager.

What Do Arizona Online Gambling Laws Mean for Residents?

If residing in Arizona, there is no need to worry when gambling online. Players are able to operate within the law when gambling online. Whether you select a instate book online, tribal casino, or an offshore gambling site, you are gambling legally.

While offshore gambling platforms aren't regulated by state authorities, it's legally permissible for you to gamble on the platform you prefer. Using offshore sites means you might lack certain state-level protections, but there may be less tax oversight and monitoring from the state.
